The website of RaceME GmbH is an internet-based marketplace for tuning parts for US vehicles.
The use of our products RaceME – RaceME Pro and RaceME Ultra is permitted only for off-road and racing applications.
Our General Terms of Use (GTC) form the basis for using the internet services on the pages raceme.eu. Please read these GTC carefully before using the services of our website. By using our pages, you agree to the validity of these terms and conditions. If you do not accept the validity of our GTC, you may not continue to use the services of RaceME GmbH.
1. Registration Requirement
In order to use our services in full, you must register as a member. By registering, you agree (a) to provide current, accurate, correct, and complete information about yourself (registration data) and (b) to update this data as necessary to keep it current, accurate, correct, and complete. If the registration data you provide is outdated, inaccurate, incorrect, or incomplete, or if RaceME GmbH has reason to believe that your registration data is outdated, inaccurate, incorrect, or incomplete, RaceME GmbH is entitled to temporarily or permanently delete your user account and exclude you from any or all services.
2. User Account, Password, and Security
When registering, you choose a member name and a password yourself (the use of an alias or nickname instead of your real name is possible). You are fully responsible for all actions carried out using your password or your account. You are obligated to inform RaceME GmbH immediately of any misuse of your password or user account, as well as of any other security breaches that come to your attention. For your own security, you must ensure that you log out of the members’ area after each use of your account. RaceME GmbH excludes any liability for damages or losses resulting from failure to comply with these regulations.
3. Data Protection
The storage of your registration data and other personal data is subject to the statutory data protection regulations. Further information can be found in our privacy policy.
4. Deletion of Your Account
You may delete your user account at any time without giving reasons. Your personal data will then be deleted immediately by RaceME GmbH. RaceME GmbH is entitled, at its own discretion, to terminate your user account (or parts thereof), your user password, or any other use of the services by you, and to delete your personal data if you have not used the services for a long period of time or if RaceME GmbH must assume that you have violated these GTC or have not complied with essential principles of the GTC. RaceME GmbH is not obligated to compensate you or third parties for any damage that may arise from the termination of your membership.
5. Copyrights
Our pages are protected by copyright. This means that the content of these pages may not be copied, distributed, transmitted, modified, or otherwise exploited unless the operator has given prior written consent.
By using our website, you acknowledge that the services and the software used in connection with the services are subject to protective rights and contain confidential information that is protected by law. In particular, the provisions of the Copyright Act and related protection rights in their currently valid version apply. Furthermore, you accept that advertising content from sponsors as well as information you receive through the services or through advertisers are also subject to copyright, trademark, patent, or other protective rights. RaceME GmbH is a registered trademark that is valid internationally. Without prior written consent from RaceME GmbH, the trademark may not be published or otherwise used.
7. Information on the Website
As the operator, we strive to keep all information about products, dealers, and prices on this website as accurate and up to date as possible. Nevertheless, we cannot guarantee the correctness and accuracy of the information provided on the website. We therefore request that our users contact the dealers listed in our service themselves if they intend to make a purchase, in order to clarify details and confirm the accuracy of prices. RaceME GmbH assumes no responsibility for actions taken based on product, dealer, or price information provided by RaceME GmbH.

9. Transactions with Third Parties

RaceME GmbH is not responsible or liable for losses or damages arising from such transactions or from the presence of such providers in the services.
10. Warranty
The use of our products is at your own risk. The products are offered in the design deemed appropriate by RaceME GmbH and subject to availability. RaceME GmbH does not warrant that the products will meet your requirements or that they will be available at all times without interruption, in a timely, secure, and error-free manner. RaceME GmbH does not provide any warranty regarding the results that may be achieved through the use of the products, the accuracy and reliability of the information obtained through the services, or that the quality of goods, services, or information obtained in connection with the services will meet your expectations. RaceME GmbH also does not warrant that the hardware and software used for the services will function error-free at all times or that any errors in the hardware or software will be corrected. Advice or information received in this context, whether in writing or orally, does not constitute any warranty by RaceME GmbH unless expressly agreed in writing.
11. Liability
All data material on our website is provided exclusively for informational purposes. Any liability of RaceME GmbH for damages of any kind arising from the use of our website and the information stored there is excluded, unless such damages were caused intentionally or by gross negligence.
The user is aware that increasing the performance of a vehicle can significantly reduce its service life, and RaceME GmbH assumes no liability for this.
RaceME GmbH is not liable for the behavior of users or other third parties resulting from improper use or misconduct. RaceME GmbH is also not liable for damages arising from the use or the inability to use our products or vehicles. RaceME GmbH is not liable to you or to third parties for damages arising from interruptions, temporary suspensions, or termination of the services. Should liability of RaceME GmbH exist for any legal reason notwithstanding the above provisions, such liability shall in any case be limited to damages caused by intentional or grossly negligent conduct and, in all other respects, shall be limited in amount to the typical average contractual damage. Any liability under the Product Liability Act remains unaffected by this. RaceME products are exclusively permitted for off-road and racing applications and are not approved for public road traffic.
Our products RaceME – RaceME Pro and RaceME Ultra are intended for racing purposes only; any other use, such as on public roads, is not permitted.
RaceME GmbH expressly reserves the right to change, supplement, delete, or temporarily or permanently discontinue parts of the pages or the entire offering without prior notice. RaceME GmbH assumes no liability for any damages or losses arising therefrom.
The above warranty and liability limitations also apply in favor of companies affiliated with the operator within the group, as well as their employees and agents.
RaceME GmbH prohibits the transmission of emails, attachments, or data that violate legal regulations (e.g., spam, viruses). RaceME GmbH cooperates with authorities and institutions to prevent such activities.
12. Software Updates
Software updates from RaceME GmbH to the user can be downloaded from our download folder. RaceME GmbH is not liable for damages that may arise from increased vehicle performance. The user is responsible for proper application.
13. General Provisions
The failure of RaceME GmbH to exercise or enforce any right or provision of these GTC does not constitute a waiver of such right or provision.
Please note that additional terms and conditions may apply if you use affiliated services, third-party content, or third-party software.
14. Amendments to These GTC
RaceME GmbH reserves the exclusive right to amend or supplement these GTC for the future. If such amendments or supplements are made, we will inform you separately. The amended or supplemented GTC shall apply if you continue to use our services after receiving notice.
15. For all customers within and outside the EU, the Conditions of Use additionally apply, which you confirmed as read before completing payment.
16. Applicable Law; Place of Jurisdiction
The use of our products and services is governed exclusively by Austrian law. For disputes arising from or in connection with the use of our products or services and/or these GTC, the Regional Court of Salzburg shall have jurisdiction.
